Recapt - Terms of Service

Last updated: September 30, 2026

Recapt is operated by Twentythree5 ("we", "us", "our"). These documents cover

the Recapt mobile application and the website at recaptapp.com (together, the

"App").

1. Acceptance of Terms

By creating an account or using the App, you agree to these Terms and to the

Privacy Policy in Part 2. If you do not agree, do not use the App.

Tapping Continue on the sign-in screen constitutes acceptance.

2. Eligibility

You must be at least 16 years old to use Recapt. The App asks for your date

of birth during setup and will not create an account for anyone under 16.

If you are under 18, you represent that your parent or legal guardian has

reviewed and agreed to these Terms on your behalf.

We do not knowingly collect personal information from anyone under 16. If we

become aware that a user is under 16, we will terminate the account and delete

the associated data promptly. If you believe a child has created an account,

contact us at the address above.

3. Account Registration

Accounts are created with a phone number and verified by SMS code. You are

responsible for keeping access to that phone number secure, and for all

activity under your account.

You agree to provide accurate information, including a genuine date of birth.

Impersonating another person is grounds for termination.

4. How Recapt Works

Recapt allows one photo per album per day. Photos are hidden until the end

of the calendar month, then revealed to that album's members together.

This has consequences you should understand before you use it:

  • A photo you take today cannot be replaced. You get one per album per day.
  • Once a month reveals, everyone in that album sees your photo for that month.
  • Photos are not stored forever. See §5 and Privacy Policy §5.

5. Photo Lifecycle and Deletion

Read this section carefully. Recapt deletes photos on a schedule. This is a

deliberate part of the product, not a failure.

Each photo moves through these states automatically:

StageWhenWhat it means
HiddenFrom capture until month endOnly you know it exists
RevealedEnd of the monthVisible to that album's members
Export window7 days after the month endsYou can save it to your device
ColdAfter the export windowStill viewable; no longer exportable
DeletedFebruary 1 of the following yearPermanently removed

**On February 1 each year, every photo from the previous year is permanently

deleted**, except photos you saved to your profile.

Before that happens you get:

  • Your annual Recapt, viewable throughout January
  • A "last chance" reminder from January 25–31 to save favourites to your profile

Photos saved to your profile are permanent. They are kept as independent

copies and survive album deletion, member removal, and the annual sweep. You

may save up to 12 photos per month to your profile.

**If you want to keep a photo, export it during its 7-day export window or save

it to your profile.** We are not liable for photos lost to this schedule, and

deletion cannot be reversed.

6. Albums and Shared Access

  • Albums are created by invitation. Members see each other's photos once a

month reveals.

  • Album owners may transfer ownership, add or remove members, and manage

permissions.

  • Photos you captured remain in an album if you leave it, unless you delete

them first. Your profile photos are unaffected.

  • Removal from an album is permanent unless you are invited again.

7. Contacts and Invitations

If you grant contacts permission, the App reads your address book **on your

device** so you can pick people to invite.

**When you send an invitation, we store that person's name and phone number on

our servers** so the invitation can be tracked and so we can connect you if

they join. We do this only for contacts you explicitly choose to invite — never

your whole address book.

People invited this way have not agreed to these Terms. See Privacy Policy §7

for their rights, including how they or you can have their record deleted.

You are responsible for having a reasonable basis to share someone's contact

details with us.

8. Beeps

Beeps are a lightweight nudge to friends who have not posted. They are limited

in number per day and are intended as social encouragement. Using Beeps to

harass someone violates §9 and will be treated as such.

9. Prohibited Conduct

**There is no tolerance for objectionable content or abusive behavior on

Recapt.**

You agree not to post, share, or send content that:

  • Is sexually explicit, pornographic, or depicts nudity
  • Harasses, bullies, threatens, defames, or intimidates any person
  • Promotes hatred or violence against any individual or group, including on the

basis of race, ethnicity, national origin, religion, disability, sex, gender

identity, sexual orientation, or age

  • Depicts or encourages violence, self-harm, or suicide
  • Sexualizes or endangers minors in any way
  • Infringes anyone's intellectual property or privacy rights
  • Is spam, a scam, or a fraudulent solicitation

You also agree not to:

  • Reverse engineer, decompile, or attempt to extract source code from the App
  • Use automated scripts, bots, or scrapers to interact with the App
  • Attempt to gain unauthorized access to other users' accounts, albums, or data
  • Interfere with or disrupt the App's servers or infrastructure
  • Use the App to transmit malware, spam, or unsolicited communications
  • Circumvent any access controls, rate limits, or content restrictions

Reporting. Any photo, message, album, or profile can be reported from within

the App: open the "…" menu or press and hold the content, then tap Report

and choose a reason. Reports are anonymous — the person reported is never told

who reported them.

Our commitment. We review every report within 24 hours. Content that

violates these rules is removed, and the accounts responsible are suspended or

permanently terminated. You can also block any user at any time from their

profile, the Friends list, or the report confirmation screen. Blocking is

immediate and mutual — neither of you will see the other's content.

10. Account Deletion and Termination

By you. You may delete your account at any time from Settings → Account →

Delete Account. When you do:

  • Your account is scheduled for deletion after a 30-day grace period
  • During that period you may cancel by signing in again
  • After 30 days your profile, photos, and personal data are permanently removed
  • Albums you own are transferred to the next most senior member

By us. We may suspend or terminate your account for violating these Terms,

with or without notice depending on severity. Repeat or severe violations of §9

result in permanent termination.

11. Intellectual Property

You own your photos. You grant us a limited, non-exclusive, royalty-free

licence to store, process, and display them solely to operate the App —

delivering them to the album members you shared them with, generating your

stats and annual Recapt, and creating the thumbnails and copies the App needs.

This licence ends when the content is deleted, except for copies retained in

routine backups for a limited period.

We do not use your photos to train machine learning models, and we do not sell

or license them to anyone.

The Recapt name, logo, design, and software are ours.

12. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND,

EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR

PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or that

photos will be preserved indefinitely. See §5 — deletion is by design.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR

ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES,

INCLUDING LOSS OF DATA, REVENUE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR

USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH

DAMAGES.

Some jurisdictions do not allow these exclusions, so they may not apply to you.

14. Governing Law

These Terms are governed by the laws of the State of Utah, United States,

without regard to its conflict of law provisions. Any disputes arising under

these Terms shall be resolved in the courts located in Utah.

15. Changes to These Terms

We may update these Terms. Material changes will be announced in the App or by

notice to you before they take effect. Continuing to use the App after a change

means you accept the updated Terms.

16. Apple App Store — Additional Terms

  • These Terms are between you and Twentythree5 only, not Apple.
  • Apple has no obligation to provide maintenance or support for the App.
  • If the App fails to conform to any applicable warranty, you may notify Apple,

and Apple will refund the purchase price (if any). Apple has no other

warranty obligation.

  • Apple is not responsible for addressing any claims relating to the App.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and

may enforce them against you.
