# Recapt — Terms of Service & Privacy Policy

## Part 1: Terms of Service
### 1. Acceptance of Terms
By downloading, installing, or using the Recapt mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.
Recapt is operated by Twentythree5 (“we,” “us,” or “our”). These Terms apply to all users of the App, including users who contribute content, information, or other materials.

### 2. Eligibility
You must be at least **13 years old** to use Recapt. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
We do not knowingly collect personal information from children under 13. If we become aware that a user is under 13, we will terminate their account and delete associated data promptly.

### 3. Account Registration
To use Recapt, you must create an account by verifying a valid mobile phone number. You are responsible for:
– Keeping your account information accurate and up to date
– Maintaining the security and confidentiality of your account
– All activity that occurs under your account
You may not create accounts for others without their permission, impersonate any person, or use the App for any unlawful purpose.

### 4. User Content
**Your Content.** Recapt allows you to capture, store, and share photos (“Content”) within shared albums with friends. You retain ownership of the Content you create.
**License Grant.** By uploading Content to Recapt, you grant us a limited, non-exclusive, royalty-free license to store, display, and transmit your Content solely to provide the App’s features to you and your authorized collaborators. We do not claim ownership of your photos.
**Your Responsibility.** You are solely responsible for the Content you capture and share. You agree not to upload Content that:
– Is illegal, obscene, defamatory, or threatening
– Violates the privacy or intellectual property rights of others
– Contains nudity, sexual content, or graphic violence
– Depicts or promotes illegal activities
We reserve the right to remove Content that violates these Terms and to suspend or terminate accounts that repeatedly do so.

### 5. Albums and Shared Access
Recapt allows users to create and join shared albums (“Cards”). By adding another user to an album or accepting an invitation:
– You acknowledge that photos you capture within that album are visible to all current members
– Album owners may transfer ownership, add or remove members, and manage permissions
– Removed members lose access to the album but photos they captured remain in the album unless deleted by an owner

### 6. Beep Feature
The Beep feature allows users to send lightweight notifications (“Beeps”) to friends. By using this feature, you agree:
– Beeps are limited to 3 per day per account
– Beeps are used solely to express social encouragement and do not constitute harassment
– Abusing the Beep feature to harass, spam, or intimidate other users may result in suspension

### 7. Notifications
Recapt may send push notifications related to album activity, friend requests, daily photo reminders, and Beeps. You may manage notification preferences within the App’s Settings at any time. Disabling notifications does not affect your ability to use the App.

### 8. Prohibited Conduct
You agree not to:
– Reverse engineer, decompile, or attempt to extract source code from the App
– Use automated scripts, bots, or scrapers to interact with the App
– Attempt to gain unauthorized access to other users’ accounts or data
– Interfere with or disrupt the App’s servers or infrastructure
– Use the App to transmit malware, spam, or unsolicited communications
– Circumvent any access controls or content restrictions

### 9. Account Deletion and Termination
**By You.** You may delete your account at any time from Settings > Account > Delete Account. Upon requesting deletion:
– Your account is scheduled for permanent deletion after a **30-day grace period**
– During this period you may cancel the deletion by contacting us
– After 30 days, your profile, photos, and personal data are permanently removed
– Ownership of albums you own is transferred to the next most senior member
**By Us.** We reserve the right to suspend or terminate your account at any time for violations of these Terms, without prior notice in cases involving serious harm to other users or the platform.

### 10. Intellectual Property
The Recapt name, logo, app design, and all related trademarks are owned by Twentythree5. Nothing in these Terms grants you a right to use our branding without our prior written permission.

### 11. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE APP IS AT YOUR SOLE RISK.

### 12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $50 USD.

### 13. Indemnification
You agree to defend, indemnify, and hold harmless Twentythree5 and its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the App, your Content, or your violation of these Terms.

### 14. Governing Law
These Terms are governed by the laws of the State of [Your State], United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in [Your State].

### 15. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the “Last Updated” date at the top of this page. Continued use of the App after changes are posted constitutes your acceptance of the updated Terms. For material changes, we will make reasonable efforts to notify you in the App.

### 16. Apple App Store — Additional Terms
If you downloaded Recapt from the Apple App Store, the following additional terms apply:
– **Acknowledgement.** These Terms are between you and Twentythree5 only, not with Apple Inc. Apple is not responsible for the App or its content.
– **Scope of License.** Your license to use the App is limited to a non-transferable license to use the App on any Apple-branded device you own or control, as permitted by the Usage Rules set forth in the App Store Terms of Service.
– **Maintenance and Support.** Apple has no obligation to provide any maintenance or support services for the App. All support requests should be directed to us at coleman.milligan@twentythree5.com.
– **Warranty.** In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
– **Product Claims.** Twentythree5, not Apple, is responsible for addressing any claims relating to the App, including product liability claims, consumer protection claims, or claims that the App fails to conform to applicable law.
– **Third-Party Intellectual Property.** If a third party claims the App infringes their intellectual property rights, Twentythree5, not Apple, is responsible for the investigation, defense, settlement, and discharge of any such claim.
– **Legal Compliance.** You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
– **Third-Party Beneficiary.** Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

## Part 2: Privacy Policy
### 1. Overview
This Privacy Policy explains how Twentythree5 (“we,” “us,” or “our”) collects, uses, stores, and protects your information when you use the Recapt mobile application. By using the App, you agree to the practices described in this policy.

### 2. Information We Collect
#### a. Information You Provide Directly
– **Phone Number** — Used to create and verify your account via SMS
– **Profile Information** — Name, username, optional bio, and profile photo you choose to set
– **Photos** — Images you capture through the App’s camera feature
– **Communications** — Feedback or support messages you send to us
#### b. Information Collected Automatically
– **Device Information** — Device model, operating system version, and unique device identifiers
– **Usage Data** — Features you use, screens you visit, timestamps of activity, and interaction patterns
– **Photo Metadata** — Time of capture, day of week, time of day, whether flash was used, whether the front camera was used, and lens type. This metadata is used to generate your personal statistics within the App.
– **Notification Tokens** — Push notification tokens used to deliver alerts to your device
#### c. Information from Third Parties
– We do not purchase or receive personal data from data brokers or advertising networks.

### 3. How We Use Your Information
We use the information we collect to:
– Create and manage your account
– Deliver the App’s core features (photo capture, albums, friend connections, Beeps)
– Generate personal stats and streaks displayed within your profile
– Send push notifications you have opted into
– Respond to your support requests
– Detect and prevent abuse, fraud, and violations of our Terms
– Improve and develop the App’s features and performance
We do not use your photos or personal data to train machine learning models or sell to advertisers.

### 4. How We Share Your Information
We do not sell your personal data. We share information only in the following circumstances:
#### a. With Other Users
– Your profile name, username, and avatar are visible to your friends and, if your account is public, to other users
– Photos you capture are visible to members of the shared album in which they were taken
– Your photo streak and total photo count are visible to friends (and publicly if your account is public)
– Beeps you send are recorded and visible to the recipient
#### b. With Service Providers
We use the following third-party services to operate the App:

#### d. Business Transfers
If Twentythree5 is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you before your data is transferred and becomes subject to a different privacy policy.

### 5. Data Retention

After account deletion is confirmed, we permanently delete your personal data within 30 days, except where retention is required by law.

### 6. Your Rights and Choices
Depending on where you live, you may have the following rights regarding your personal data:
– **Access** — Request a copy of the personal data we hold about you
– **Correction** — Request correction of inaccurate data
– **Deletion** — Request deletion of your account and associated data (via Settings > Account > Delete Account, or by contacting us)
– **Portability** — Request an export of your data in a machine-readable format
– **Opt-out of notifications** — Manage notification preferences in Settings at any time
– **Private account** — Limit your profile visibility to accepted friends only via Settings > Privacy

**California Residents (CCPA).** You have the right to know what personal information we collect, to request deletion, and to opt out of the sale of your personal information. We do not sell personal information. To submit a request, contact us at the email above.
**EEA / UK Residents (GDPR).** Our legal basis for processing your data is the performance of our contract with you (providing the App’s features) and our legitimate interests in operating a safe and functional service. You may lodge a complaint with your local data protection authority if you believe we have processed your data unlawfully.

### 7. Data Security
We take reasonable technical and organizational measures to protect your data, including:
– Photos are stored in AWS S3 with access controlled by time-limited presigned URLs
– Database access is governed by row-level security policies
– Account access requires phone number verification
– Data is transmitted over HTTPS/TLS
No security system is impenetrable. While we strive to protect your data, we cannot guarantee absolute security and are not responsible for unauthorized access beyond our reasonable control.

### 8. Camera and Photo Access
Recapt requires access to your device camera to capture photos. This access is used solely for in-app photo capture. We do not access your device photo library unless you explicitly choose to import a photo from it. You may revoke camera access at any time in your device Settings, though this will prevent core App functionality from working.

### 9. Push Notifications
With your permission, we send push notifications for:
– Daily photo reminders
– Album reveals
– Friend requests and acceptances
– Album invitations
– Beeps from friends
– New photos added to your albums
You can manage each notification type independently in Settings > Notifications, or disable all notifications through your device Settings.

### 10. Children’s Privacy
Recapt is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, please contact us and we will delete it promptly.

### 11. Apple Platform Privacy Disclosures
In compliance with Apple’s App Store privacy requirements, the following data types are collected and linked to your identity:

The App may contain links to third-party websites (such as a Help Center or Legal page). We are not responsible for the privacy practices of those sites and encourage you to review their privacy policies.

We may update this Privacy Policy from time to time. We will notify you of significant changes by updating the “Last Updated” date and, where appropriate, by sending a notification through the App. Continued use of the App after changes are posted constitutes your acceptance.
